 Same-sex Marriage Appeal

A deadline’s been set for opening arguments against the court order striking down Montana’s gay marriage ban. State Attorney General Tim Fox says its his duty to uphold Montana’s constitution. The gay marriage ban is a constitutional amendment.

The 9th U.S. Circuit Court of appeals has given Fox until February 27 to submit his arguments for why the law does not violate the U.S. Constitution.

Open Meeting Laws

More than 20 media groups have asked a court to hold the Montana House Republican Caucus in contempt for holding an unpublicized meeting.

State courts have ruled that caucuses are public bodies and subject to Montana's right-to-know laws.

The Great Falls Tribune  reports that about 50 Republican lawmakers met at a Helena hotel last Thursday to discuss the 2015 legislative session.

Republican Senator Jeff Essmann has said the gathering was not subject to open meetings law
